Reservation of Rights
Nothing in this Agreement restricts or limits any legal rights or remedies available to the Company under applicable laws, whether statutory, contractual, or equitable.
Indemnity
You agree to defend, indemnify, and hold harmless the Company, along with its affiliates, directors, employees, partners, and service providers, from and against any claims, liabilities, damages, losses, or expenses (including legal fees) that arise due to:
Your use or misuse of the Application
Your breach of these Terms
Your violation of applicable laws or regulations
Any infringement of third-party rights
Disclaimer of Warranties
The Application is made available on an “as is” and “as available” basis.
To the fullest extent permitted by law, the Company expressly disclaims all warranties, including but not limited to:
Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
We do not guarantee that:
The Application will always meet your expectations
The service will be uninterrupted or error-free
Any defects or issues will be fixed immediately
Some jurisdictions may not allow certain exclusions, so parts of this section may not apply to you.
Limitation of Liability
To the maximum extent permitted under applicable law:
The total liability of the Company shall not exceed:
The amount you paid for the Application, or
USD $100, whichever is lower
The Company shall not be responsible for any:
Indirect or consequential damages
Loss of data, profits, or business opportunities
Incidental or special damages
Severability
If any clause within this Agreement is determined to be invalid or unenforceable, that clause will be modified to the minimum extent necessary, and all remaining provisions will continue to be valid and enforceable.
No Waiver
Failure by the Company to enforce any provision of this Agreement shall not be considered a waiver of that provision or any future enforcement rights.
Product Responsibility
The Application is provided without any guarantees or assurances regarding performance, reliability, or suitability for a specific purpose.
Compliance with U.S. Laws
By using the Application, you confirm that:
You are not located in a country subject to U.S. trade sanctions or embargoes
You are not listed on any U.S. government restricted or prohibited parties list
Modifications to Terms
We reserve the right to update or revise this Agreement at any time.
Significant changes may be communicated in advance (where applicable)
Continued use of the Application after updates means you accept the revised Terms
Applicable Law
This Agreement shall be governed and interpreted in accordance with the laws of India, without regard to conflict of law principles.
Complete Agreement
These Terms represent the full and complete understanding between you and the Company regarding the use of the Application and replace any prior agreements or understandings.
